Any use of this Website (“Website”), provided by FANUC Europe Cooperation, a public limited company, located at 7, rue Benedikt Zender, 6468 Echternach, Luxembourg ("FANUC"), is subject to these term of use (“Terms of Use”). These Terms of Use may be enhanced, amended or replaced by other terms and conditions, in particular with respect to the offer of products and/or services.

By accessing this Website and using the offered services you agree to be bound to the current Terms of Use. If you disagree with the Terms of Use or parts of it, you may not use this Website.

1. Copyright and rights of use

FANUC owns all rights, titles, and/or licenses to the content and structure of the Website. This includes, but is not limited to functionalities, documentation, instructions, information, data, text, pictures, and sound materials which are contained on the Website (“Content”) and also to all software and technical components which are used to ensure that the Website is functioning properly. Unless the User uses extended services which are governed by special conditions, the Content may be used within the limits as defined by the functionality offered on the Website.

In the event that any Content of the Website is accessible for download or print, FANUC grants the User a non-exclusive, non-transferable, limited right for personal and non-commercial use. This right does not allow the User to make any commercial use of the Content of the Website, but the User shall use the Content to make commercial decisions, such as to enter into negotiations with FANUC regarding FANUC’s products advertised on the Website. In all other respects, the User shall not acquire any rights in or to the Content of the Website, unless otherwise authorised by FANUC.

In particular, the User shall not:

  1. modify, remove copyright and other proprietary notices contained in the content;
  2. modify the content in any way or reproduce or publicly display, perform, or distribute or otherwise use them for any public or commercial purpose;
  3. transfer the content to any other third party;
  4. use this Website in any way that causes, or may cause, damage to the Website or impairment of the availability or accessibility of the Website; or in any way which is unlawful, fraudulent, illegal or harmful etc. or in connection with such purpose or activity.

The downloadable or printable Content will be watermarked with User’s e-mail address provided during the registration or change e-mail process. Such watermark shall prevent the Content from unauthorised dissemination.

2. Registration

For registration the User shall give accurate information, and when necessary, update such information without undue delay (in particular User’s e-mail address). The User shall ensure that User’s data (e.g. User ID or password) is not accessible by third parties and is liable for all actions and activities carries out under its data.

FANUC is entitled, at any time and without obligation to give reasons, to deny the User right to access the password-protected area by blocking its User data, in particular if the User:

  1. uses false data for the purpose of registration;
  2. violates these Terms of Use;
  3. violates any applicable laws in the access or use of the Website;
  4. did not use the Website for a long period of time.

The User may at any time terminate its registration, provided that the deletion will not violate the proper performance of any contractual relationships. In such event FANUC will delete all User’s personally identifiable data as soon as these data are no longer needed.

3. Trademarks and logos

The brand names, trademarks and logos used on the Website are protected by trademark and copyright law. It is therefore not allowed to use such trademarks and logos without the prior consent of the respective holder of the rights.

4. Responsibility for information and Content, availability

Unless otherwise explicitly stated, the information and Content provided do not constitute a binding offer by FANUC to enter into a contract. Consequently, any description of products or services shall not be understood as an offer which may be accepted in a way automatically giving rise to contractual obligations.

By displaying information FANUC does not provide advice and also does not recommend or request that a particular product or service should be purchased. The only purpose of the information provided is to help User to independently decide as to whether a particular product or service is fit for a particular purpose.

The Website and the retrievable information and Content are compiled carefully. FANUC aims to ensure that all information and Content provided by the Website are up to date and correct. However, it cannot be completely excluded that the provided information and contents are incorrect or do not represent the current state. Therefore, FANUC is not responsible for the timeliness, accuracy or completeness of the information and Content provided within the Website, particular with regard to price or product information. Also, FANUC does not assume any warranty that the information and Content are free from defects or are suitable for any particular purpose. Any reliance on any such opinion, advice, statement, memorandum, or information shall be at your sole risk.

FANUC does not warrant that the services from the Website will be uninterrupted, timely or error-free, although it is provided to the best ability. FANUC reserves the right to modify or discontinue, temporarily or permanently, this Website and/or related services without notice. The User agrees that FANUC will not be liable for any modification, suspension or discontinuance of the operation of this Website and/or related services.

5. Hyperlinks and third party websites

The Website may contain links to websites of third parties (e.g. YouTube, Twitter or Facebook). FANUC does not accept liability for the contents of such websites and does not make representations about or endorse such websites or their contents as its own, as FANUC neither is responsible for the contents and information given thereon, nor does warrant that such information and content are up to date, correct, and complete. The use of such links shall be at the sole risk of the User.

However, User should notify FANUC immediately in the event that they detect illegal, inappropriate or incorrect information or contents within the linked websites.

Creating frame or inline links from other websites to the Website without prior written consent of FANUC is expressly forbidden. In particular, User is not permitted to use a hyperlink to include or display the Websites or its respective content in a frame.

6. Information provided by User

FANUC does not want User to, and User should not, send any confidential or proprietary information to FANUC via the Website. User agrees that any information or materials that provided to FANUC will not be considered confidential or proprietary. By providing any such information or materials to FANUC, User grants to FANUC an unrestricted, irrevocable, worldwide, royalty-free license to use, reproduce, display, publicly perform, transmit, change and distribute such information and materials,

and User further agree that FANUC is free to use any ideas, concepts or know-how that User or individuals acting on User’s behalf provide to FANUC. User further recognises that FANUC does not want User to, and User warrants that will not, provide any information or materials to FANUC that is defamatory, threatening, obscene, harassing, or otherwise unlawful, or that incorporates the proprietary material of another. FANUC reserves the right to remove such content from the Website.

7. Limitation of liability

FANUC shall be liable for bodily injury, for damages or losses caused by wilful misconduct or gross negligence. Any further liability of FANUC, especially, but not limited to liability for damages or losses caused by slight negligence, shall be excluded to the maximum extent allowed under the applicable statutory regulations.

Notwithstanding the preceding provisions any contributory negligence of the user, in particular the lack of provision of cooperation services, organizational errors, inadequate data backup or a violation of other contractual obligations, reduces the amount of any claim for damages.

8. Export Control

Please be aware that some of FANUC manuals may be subject to export control regulations. Depending on the country of destination and the end-use of the related machine, some restrictions may apply.

9. Changes

FANUC may terminate, change, suspend or discontinue any of the operations on the Website, including the availability of any features of the Website, at any time. FANUC cannot accept any liability for the continuous availability of the Website.

FANUC reserves the right to change these Terms of Use from time to time as it sees fit.
